Divorce

Divorce, also known as “dissolution of marriage” in California, is based on “no fault” and either party may simply state the reason for the divorce is “irreconcilable differences”.   Parties may not be divorced any earlier than six months from the date of service of the Petition and Summons. 

There are four major parts of a divorce action:

  1. Child custody/parenting time
  2. Child support and related issues (e.g., health insurance)
  3. Spousal support (temporary and long-term spousal support)
  4. The division of property and debts.

Also addressed during most dissolution actions are the payment of attorney’s fees and costs and dissolving the marriage.
